Contractor placed on debarment list for violating prevailing wage


Jefferson City – Attorney General Chris Koster announced that a contractor in Mountain Grove was placed on Missouri’s contractor debarment list for one year for violating the state’s prevailing wage law.

David Mollohan, operator of M & D Excavating, pleaded guilty to not paying the prevailing wage to 14 men on a public works project on Highway 5 in Camden County. In addition to the debarment, Mollohan was sentenced to a 60-day suspended jail sentence, two years of court-supervised probation, and a fine of $500.

Koster said being placed on the debarment list means Mollohan, and any company he owns, cannot contract directly or indirectly with any public body for the construction of any public works for that period of time.

“Missouri’s prevailing wage law is clear and will be enforced border-to-border throughout our state,” Koster said.  “This Attorney General’s office takes prevailing wage violations seriously and will continue to aggressively protect the rights of working Missourians.”

Koster has placed more than one-third of the entities on the debarment list since 1992.

Mollohan is the 16th contractor to be put on the debarment list since 1992, and the 6th to have been prosecuted by Koster – two as Attorney General and four as Cass County Prosecutor.

Mollohan has repaid more than $41,000 in full restitution to the 14 workers.

The Missouri Labor Department’s Division of Labor Standards referred the case to the Attorney General following an investigation.
